Terms of Service

These terms govern your use of etcbot.ai and the EtcBot platform provided by FTH Digital Marketing (Riyadh). By creating an account or using the site you agree to these terms.

1. The service

EtcBot is a software platform for managing business communication over WhatsApp: a team inbox, template management, campaigns, and customer data management. The service is built on Meta's official WhatsApp Cloud API and is subject to its availability and terms.

2. Accounts & eligibility

The service is intended for businesses. You agree to provide accurate information, keep your credentials confidential, and accept responsibility for all activity under your account. We may refuse or suspend registration in accordance with these terms.

3. Your relationship with Meta

Your WhatsApp Business Account and phone number are assets you own with Meta, and Meta bills you directly for message fees. Your use of the API is subject to WhatsApp's and Meta's business terms and policies, and you are responsible for complying with them.

4. Acceptable use

You may not use the platform to message recipients without their prior documented consent, for fraudulent or misleading messages, or for any activity violating Saudi law, Meta policies, or lawful-content requirements. We reserve the right to suspend or terminate any account in breach, to protect other customers and the platform.

5. End-customer consent

You are the controller of your end-customers' data and responsible for obtaining their prior documented consent before any marketing messages, and for honoring opt-out requests. The platform provides tooling to document consent and enforce opt-outs; this does not transfer your legal responsibility.

6. Fees

The platform subscription is paid to us per the published plan. WhatsApp message fees are paid by you directly to Meta and we take no margin on them. Launch-period prices are introductory and may be revised with prior notice.

7. Data & ownership

Your data and your customers' data remain yours; we process them per the privacy policy and a data processing agreement. The platform's software, marks, and content belong to us or our licensors.

8. Service level & liability

We use commercially reasonable efforts to keep the service available and stable, and do not guarantee uninterrupted operation, particularly where third parties such as Meta are involved. To the extent permitted by law, we are not liable for indirect damages, and our total liability does not exceed the amounts you paid us in the twelve months preceding the claim.

9. Termination

You may cancel your subscription effective at the end of the paid cycle. We may suspend or terminate the service upon material breach of these terms. Upon termination we enable you to export your data within a reasonable period, after which it is deleted per the retention policy.

10. General

These terms are governed by the laws of the Kingdom of Saudi Arabia, with the courts of Riyadh having jurisdiction over any dispute. We may update the terms with notice via the site or email; continued use after effectiveness constitutes acceptance.
